This Privacy Notice for EMRE OZER (doing business as Nerdy: AI Study & Quizzes) ("we," "us," or "our"), describes how and why we might access, collect, store, use, and/or share ("process") your personal information when you use our services ("Services"), including when you:
- Download and use our mobile application (Nerdy: AI Study & Quizzes), or any other application of ours that links to this Privacy Notice.
- Use Nerdy: AI Study & Quizzes. Nerdy is an educational tool leveraging Artificial Intelligence to help users create, manage, and study flashcards efficiently. The app processes user-provided content (including text, PDFs, images, and audio) to automatically generate study decks and uses onboarding information to tailor the learning experience.
- Engage with us in other related ways, including any marketing or events.

1. WHAT INFORMATION DO WE COLLECT?
Personal information you disclose to us
In Short: We collect personal information that you provide to us, including onboarding demographic data and study materials for AI processing.
We collect personal information that you voluntarily provide to us when you register on the Services or otherwise contact us.
- Onboarding & Profile Data: To personalize your learning experience, we collect your name, age, school/institution, and degree/study program information.
- Account Information: Email addresses, usernames, and authentication data.
- User-Generated Study Content: Content you upload for the purpose of flashcard generation, which may include raw text, PDF documents, image files, and audio recordings.
Payment Data: We may collect data necessary to process your payment if you choose to subscribe to premium features. All payment data is handled securely by our payment processors (such as Apple). You may find Apple's privacy notice here: https://www.apple.com/legal/privacy.
Application Data
If you use our application, we may also collect the following information:
- Mobile Device Access: We may request access to your mobile device's storage, camera, or microphone to allow you to upload PDFs, images, and audio files for flashcard generation.
- Usage & Diagnostic Data: We automatically collect device information (such as your mobile device ID, model, and manufacturer), operating system, IP address, and crash reports. This data helps us monitor app stability and improve performance.
2. HOW DO WE PROCESS YOUR INFORMATION & AI DATA OWNERSHIP?
In Short: We process your information to provide our Services. Your uploaded files are used exclusively to generate your flashcards and are NOT used to train foundational AI models.
We process your personal information for a variety of reasons, including:
- To facilitate account creation and profile personalization.
- To generate and deliver study materials using Artificial Intelligence. We process the text, PDFs, images, and audio files you upload using third-party AI APIs (specifically the Google Gemini API) to automatically extract key information and generate educational flashcards.
AI Data Training & Ownership: You retain all ownership rights to the documents, audio, and text you upload, as well as the flashcards generated from them. In accordance with our API provider's enterprise terms, the data you upload is NOT used to train, fine-tune, or improve Google's foundational AI models. Your data is processed transiently solely to provide the flashcard generation service to you.
3. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?
- Service Providers: We share your data with third-party vendors who perform services on our behalf. This includes our AI API providers (to read your uploaded content), analytics tools (to monitor app crashes), and subscription management platforms.
- Business Transfers: We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, or acquisition.
4. HOW LONG DO WE KEEP YOUR INFORMATION?
We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice. Once you delete your account, your personal information, uploaded documents, and generated flashcards will be permanently removed from our active databases, unless a longer retention period is required by law.
5. DO WE COLLECT INFORMATION FROM MINORS?
In Short: We use the age information collected during onboarding to ensure compliance with minor privacy laws like COPPA.
We collect age information during onboarding to tailor the educational experience and ensure compliance with the Children's Online Privacy Protection Act (COPPA). We do not knowingly market to or solicit personal data from children under the age of 13 without verifiable parental consent. If we learn we have collected personal information from a child under 13 without consent, we will promptly delete that data and deactivate the account.
6. ACCOUNT DELETION & YOUR PRIVACY RIGHTS
In Short: You have full control over your data and can delete your account directly inside the app at any time.
In-App Account Deletion: You have the right to request the deletion of your personal data. You can delete your account and all associated study materials directly within the application at any time. To do this:
- Navigate to your Profile.
- Tap on Settings.
- Scroll to the bottom and click Delete Account.
Upon confirming deletion, your account, uploaded files, and flashcards will be permanently erased from our active servers.
7. SPECIFIC RIGHTS FOR UNITED STATES RESIDENTS (CALIFORNIA / CCPA)
In Short: If you are a resident of California, you are granted specific rights regarding access to your personal information. We do not sell your personal information.
If you are a resident of California, the California Consumer Privacy Act (CCPA) provides you with specific rights regarding your personal information:
- Right to Know: You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months.
- Right to Delete: You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. You can exercise this directly via the In-App Account Deletion feature.
- Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights.
Do Not Sell My Personal Information: We do not sell your personal information to third parties. We have not sold any personal information in the preceding 12 months. We only share data with service providers necessary to operate the Nerdy application.
